Does a Seller Have to Disclose if a Home is Haunted?
- I like to ask my buyer clients what they are looking for in a home.
You wouldn't believe how many buyers tell me they want a home that isn't haunted!! I get it a lot. Sure, maybe 3 bedrooms, basement, near a school, within 30 min of their work...but no ghosts...really??!?
Yes, really. Many buyers tell me they want to make sure they don't buy a home that is haunted.
One buyer even asked me if we could come back in the evening to make sure she didn't see a ghost!
Here, in Indiana, a seller does not have to disclose if a home is haunted.
However, if a buyer directly inquires with a question and the seller truthfully knows the answer...they must answer truthfully. There could be consequences if they don't.
This goes for questions as simple as
"Does the furnace work?"
"Do you get water in the basement when it rains?"
"Has anyone been murdered in the home?"
"Did anyone DIE in the home?"
"Are there any underground storage tanks on the property?"
So, as of today, any buyer can ask a seller if the home is haunted, and if the seller knows, they must answer truthfully. The seller does not have to disclose this (or a murder or death in the home) unless asked.
I made a quick video on this subject--- and even included a story of a time when I was showing a buyer a home that we thought was haunted. True story, my clients can confirm this!! Yes, we think the house we were looking at was haunted and we ran out of there!!
